PETITION to
CITY COUNCIL of the CITY OF SHERIDAN, WYOMING
REQUESTING ADOPTION OF AN ORDINANCE
for
FORMATION of a DOWNTOWN DEVELOPMENT AUTHORITY
The undersigned, being persons owning nonresidential property within the city limits of the City of Sheridan, Sheridan County, Wyoming, which property is located within the proposed boundaries of the Sheridan Downtown Development District, petition the City Council of the City of Sheridan, Wyoming, to hold a public hearing upon this Petition for the purposes of receiving public comment upon this Petition, and complying with the provisions of Wyoming Statutes sections 15-9-201 through 15-9-223 (the, “Act”), as amended, for adopting an ordinance creating the Sheridan Downtown Development Authority (the “Authority”) and the Sheridan Downtown Development District (the, “District”).

The boundaries of the proposed District are as set forth on Exhibit ”A”.

The undersigned constitute not less than twenty-five percent (25%) of the persons owning nonresidential property within the proposed district.

The creation of the Authority and the District will serve a public use and will promote the health, safety, prosperity, security and general welfare of the inhabitants of the District and of the people of this state; will halt or prevent deterioration of property values or structures within the central business district of Sheridan, Wyoming; will halt or prevent the growth of blighted areas within the District; and will assist the City of Sheridan in the development and redevelopment of the District and in the overall planning to restore or provide for the continuance of the health and benefit the property within the boundaries of the District.

The proposed Authority will be under the direct supervision and control of a board of directors appointed by the City and will be operated, and have all of the powers and responsibilities of a downtown development authority as set forth in the Act; provided that this authority will have the authority to make a special assessment against real property with the authority unless such action is first submitted to a vote of persons owning real property within the authority, and approved by the Sheridan City Council, as prescribed by Wyoming Statutes section 15-9-217(b).

In the event that the Sheridan City Council adopts an ordinance or resolution by which bonds are issued pursuant to the Act, the ordinance or resolution will specify the maximum net effective interest rate of the bonds.

This Petition will be circulated in the form of duplicate originals and the combined originals submitted to the Sheridan City Council as a single Petition.
